1. Introduction and Acceptance
These Terms of Use and End User Licence Agreement (the "Terms" or this "Agreement") form a legally binding agreement between Taleh Sadıqov, an individual developer based in the Republic of Azerbaijan, trading as GemuZen Studio ("GemuZen Studio", "Developer", "we", "us" or "our"), and you, the person who downloads, installs or uses the GemuZen mobile game, together with its updates, content and related online features (the "Game").
Please read these Terms carefully. By downloading, installing or using the Game, you confirm that you accept these Terms. If you do not accept them, please do not use the Game and uninstall it from your devices.
Our Refund Policy and Copyright Notice form part of these Terms. Where one of them deals with a specific subject (for example, the Refund Policy for refunds), that document prevails for that subject. Our Privacy Policy and Cookie Policy explain how we process personal data and use cookies; they are information notices and are not part of this contract.
2. Definitions
- "Coins" (also referred to in the Game as ZenCoins) means the virtual currency used inside the Game.
- "Virtual Items" means avatars, themes, jokers, collectible cards, Mystic Packs and other digital content usable only inside the Game.
- "Mystic Pack" means a free pack that contains a randomly selected collectible card, obtained through gameplay or by choosing to watch a rewarded advertisement.
- "Mystic Card Offer" means the offer shown in the treasure screen where a specific, clearly displayed card can be bought directly with Coins at a fixed price.
- "Anonymous Game ID" means the random identifier created for your installation of the Game, as described in the Privacy Policy.
- "App Store" means Google Play, the Apple App Store or another authorised store through which the Game is distributed.
- "Including" means "including without limitation". Headings are for convenience only and do not affect interpretation.
3. Eligibility and Age Requirements
The Game is designed for a general audience. You may use the Game only if you are at least 13 years old, or older where the law of your country requires a higher minimum age to agree to these Terms or to have personal data processed (for example up to 16 years in parts of the European Economic Area).
If you are under the age of majority in your country, you may use the Game only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf and is responsible for your use of the Game, including any purchases.
Parents and guardians are encouraged to use the parental controls, purchase approval settings and content restrictions offered by their device and App Store.
Where the law requires it, App Stores may provide us with an age range or parental-approval signal for your account. Where we receive such a signal, we may use it to enable or restrict features so that your experience is age-appropriate, and we use it only for legal compliance and safety purposes, as described in our Privacy Policy.
4. Child Safety
We are committed to a safe environment for all players. The Game strictly prohibits any content or behaviour that exploits or endangers children, including child sexual abuse material (CSAM), grooming, sextortion, predatory behaviour towards minors and any content that sexualises minors. Any violation results in immediate and permanent loss of access to the Game's online features and may be reported to the competent authorities, including the National Center for Missing & Exploited Children (NCMEC) where applicable.
5. Changes to These Terms
We may update these Terms, for example to reflect new features, legal requirements or App Store rules. Where a change is material and adversely affects you, we will give you reasonable advance notice (for example through a message in the Game, a notice on our website, or a notice in the update description) unless the change must be made immediately for legal or security reasons.
The updated Terms apply from the date they are published or from the date stated in the notice. If you do not accept the updated Terms, you may stop using the Game and uninstall it; where the law provides additional rights (for example, a right to terminate and receive a refund for unused paid content), those rights apply. Your continued use of the Game after the changes take effect means that you accept the updated Terms, to the extent permitted by applicable law.
6. App Store Terms and Platform Rules
Your download and use of the Game is also subject to the terms, payment rules and policies of the App Store you use. Where the mandatory rules of an App Store conflict with these Terms, the App Store's rules prevail for the matters they govern (for example, billing and refunds). Nothing in these Terms limits any rights granted to you by an App Store, by consumer protection law or by other mandatory law.
7. Licence Grant
Subject to your compliance with these Terms, we grant you a limited, personal, revocable, non-exclusive, non-transferable and non-sublicensable licence to download, install and use the Game on devices that you own or control, for your own personal, non-commercial entertainment. The Game is licensed, not sold. We and our licensors retain all rights that are not expressly granted to you.
8. Licence Restrictions
Except where applicable law expressly allows it (for example, certain rights to decompile software for interoperability) or where we give prior written permission, you must not: copy, reproduce, distribute, sublicense, rent, lease, sell or commercially exploit the Game; reverse engineer, decompile or disassemble the Game; modify, translate or create derivative works of the Game; bypass technical protection or security measures; circumvent in-app purchase systems; tamper with game files or saved data; alter Coin or item balances; use bots, macros, automation, memory editors, cheat tools or modified clients; exploit software vulnerabilities; or remove any copyright, trademark or attribution notice. Any such activity is a breach of these Terms and may lead to the measures described in Sections 26, 32 and 41.
9. Intellectual Property
The Game and all of its elements are protected by copyright, trademark and other intellectual property laws. Unless stated otherwise, all rights in the Game, to the extent they are protected by law, are owned by or licensed to GemuZen Studio, including: gameplay mechanics and design; software and source code; the user interface and visual design; animations and effects; icons, avatars, themes and collectible cards; the Collection Treasure, Weekly League and ranking systems; Coins; music and sound effects; text, translations and databases; artwork, logos and branding; and promotional materials. Nothing in these Terms transfers ownership of any of these to you.
10. Third-Party Materials, Attributions and Open-Source Components
The Game includes third-party technologies, software libraries, fonts, images, illustrations and audio that are licensed, open-source, royalty-free or otherwise authorised for use ("Third-Party Materials"). All rights in Third-Party Materials remain with their owners. You receive no rights in them beyond using them as part of the Game.
Attributions (illustrative, and updated from time to time):
- Creative assets: a small number of icons from Freepik (freepik.com, including icons by the contributor rawpixel.com) and Vecteezy, modified by us, and sound effects from Pixabay, used under their respective licences. The collectible card artwork, the logo and the app icon are our own work.
- Country flags: based on public-domain flag artwork made available through Flagpedia (flagpedia.net), which is derived from Wikimedia Commons vector files.
- Fonts: the Inter typeface, used under the SIL Open Font License 1.1, in the Game and on our website (served from our own server).
- Frameworks and SDKs: Capacitor and its official plugins (MIT Licence), the Capawesome Firebase plugins (Apache Licence 2.0), the Firebase SDKs (Apache Licence 2.0 for their open-source parts), the Google Mobile Ads (AdMob) SDK and User Messaging Platform, AndroidX Media3 (ExoPlayer) and other AndroidX libraries (Apache Licence 2.0), the Google Play In-App Review library, the Android SDK and, where applicable, Apple's SDKs.
- Other open-source software distributed under licences such as MIT, Apache 2.0, BSD or ISC. Those licences continue to apply to the relevant components and nothing in these Terms limits the rights they grant you.
You may not extract, copy, redistribute, resell or separately license any asset contained in the Game, or remove attribution or licence notices. We may add, replace or remove Third-Party Materials at any time.
A current list of components and their licences is published at gemuzen.com/licenses.
11. AI-Assisted Content
We may use artificial intelligence tools to assist in creating or improving parts of the Game, such as artwork, icons, collectible card illustrations, sound, translations, interface text or code. In particular, the Game's background music was generated with Google's generative AI music tools and then selected, edited and arranged by us. All AI-assisted content is reviewed, selected and integrated by us before it is published. The Game does not generate content about, or depicting, real identifiable people, and it does not create AI content at your request. We do not warrant that AI-assisted outputs are free of errors, and we may change or replace the tools we use at any time, provided that such use complies with applicable law and the terms of the respective providers.
12. Game Features
GemuZen is a single-player puzzle game played for entertainment. Its features currently include: the merge-based puzzle board with selectable board sizes; jokers (undo, hammer, swap, refresh); colour progression; daily bonuses and daily quests; the Serenity Reward (Coins that accumulate, up to a limit, while you are away); an optional second chance when the board is full; the Collection Treasure with collectible cards, free Mystic Packs and the Mystic Card Offer; collection and grand final rewards; the Weekly League and global rankings; avatars and themes; Coins; optional rewarded advertisements; cloud save; optional reminder notifications; and an optional sharing feature.
Feature availability may depend on your country, device, operating system, App Store policies, network conditions and third-party service availability. No feature is guaranteed to remain permanently available; see Sections 33 and 34 for how we handle changes and discontinuation.
13. Coins (Virtual Currency)
Coins are a limited, personal, revocable licence to access certain features of the Game. Coins: have no monetary value outside the Game; are not money, deposits, e-money or any financial instrument; cannot be exchanged for cash or any item of real-world value; cannot be transferred, sold, traded, gifted or inherited; do not earn interest; and are not your property.
You can obtain Coins by playing, by claiming free rewards, by choosing to watch rewarded advertisements or, where available, by purchasing them through your App Store. We may change how Coins are earned, priced, balanced and spent, and may introduce limits, provided that we do so for valid reasons and, where a change materially and adversely affects Coins you have already purchased, we will give reasonable notice as described in Section 33.
Coins have no expiry date while the Game is available to you. If applicable law in your country grants you further rights regarding unused paid virtual currency, those rights apply.
14. Virtual Items
Virtual Items (including avatars, themes, jokers and collectible cards) are licensed to you for use inside the Game only. They have no monetary value, cannot be transferred between players or accounts, cannot be traded outside the Game, and cannot be exchanged for cash. We may rebalance, modify, replace or remove Virtual Items where reasonably necessary for gameplay balance, technical maintenance, security, fraud prevention or legal compliance, subject to Section 33.
15. Free Mystic Packs and Published Probabilities
Mystic Packs cannot be bought. They are obtained only for free: as a random drop during gameplay, or by choosing to watch an optional rewarded advertisement. Coins and real money cannot be used to open a Mystic Pack.
A Mystic Pack contains one randomly selected collectible card. The probability of each rarity is displayed in the Game before you open a pack, currently: Common 80%, Rare 15%, Epic 4% and Legendary 1%. In addition, a protection mechanism guarantees at least an Epic card within every ten packs: if nine packs in a row have not contained an Epic or Legendary card, the next pack contains an Epic card (85%) or a Legendary card (15%). Duplicate cards are automatically converted into a small Coin reward. We may adjust these mechanics and will update the displayed probabilities accordingly.
Because Mystic Packs are never purchased with money or with Coins, they are not "paid random items", "loot boxes" or any form of gambling. No wager is made, no stake is required and no prize of real-world value can be won.
16. Mystic Card Offer (Direct Purchase)
The treasure screen may display a Mystic Card Offer: one specific collectible card that you do not yet own, shown with its image, name, rarity and a fixed price in Coins. If you choose to buy it, you receive exactly the card shown; nothing is left to chance at the moment of purchase. A confirmation step is shown before Coins are spent.
Which card is displayed is chosen by the Game from the cards you do not yet own, without regard to your identity, spending or behaviour. You may also refresh the displayed card by choosing to watch a rewarded advertisement, subject to a daily limit; refreshing changes only which card is offered for sale and never grants a card by itself.
Prices are shown in Coins in the Game and may be changed for future offers. The offer is a direct purchase of a known item and is not a random-item mechanic.
17. Collection and Grand Final Rewards
Completing a card collection unlocks a one-time Coin reward, which you may claim either directly or, if you choose, at a doubled amount by watching an optional rewarded advertisement. Completing all collections unlocks an additional one-time grand final reward on the same basis. The amounts are displayed in the Game and may be adjusted for future players and future updates. Rewards already credited to you are not withdrawn as a result of such adjustments, except in cases of fraud or error.
18. Rewarded Advertisements
The Game contains optional rewarded advertisements. Watching them is entirely voluntary and is never required to play or to progress. In exchange, you may receive benefits such as Coins, jokers, a free Mystic Pack, a refreshed Mystic Card Offer, a second chance when the board is full, or a multiplied reward when you unlock a new colour.
Reward availability depends on advertising inventory, your country, your connection and advertiser eligibility, and daily limits apply. We cannot guarantee that an advertisement will always be available. Attempting to manipulate, automate, simulate or fraudulently obtain advertising rewards is prohibited and may result in the loss of affected benefits or of access to the reward features.
19. Advertising Generally
The Game is free to play and is funded by advertising and optional purchases. Where required by law (for example in the European Economic Area, the United Kingdom and Switzerland), we ask for your consent before advertising is personalised, and you can change your choice as described in our Privacy Policy. We may introduce other advertising formats in the future; if we do, the Game will state this and, where required, ask for your consent.
20. In-App Purchases
The Game may offer optional purchases. What is sold for real money are Coin packs and bundles (for example the Starter, Pro and Master packs), which contain Coins and, in the case of bundles, a stated number of jokers. All other content (cards, avatars, themes) is obtained with Coins or for free inside the Game. The exact contents and price of each pack are shown before you buy.
All purchases are processed exclusively by your App Store (for example Google Play Billing or Apple In-App Purchase), which handles the payment and, in many countries, is responsible for collecting and remitting the applicable taxes. We do not receive or store your payment card details. Prices displayed in the Game include applicable taxes where required and are set in the currency of your App Store account; the amount actually charged and any currency conversion are determined by the App Store and your payment provider.
Coins and any jokers included in a bundle are delivered to your Game immediately after the App Store confirms the transaction. Because digital content is supplied immediately and is consumed within the Game, and to the extent permitted by applicable law, purchases are final once delivered.
Consumers in the European Union, the EEA and the United Kingdom normally have a 14-day right of withdrawal for digital content. Before you confirm a purchase, the Game asks you to expressly consent to immediate delivery of the Coins or bundle and to acknowledge that you lose the right of withdrawal once delivery is complete. Once delivery is complete, the right of withdrawal no longer applies, to the extent permitted by law. This does not affect your statutory rights if the digital content is faulty or not as described.
Refunds are handled primarily by your App Store under its policies. Please also read our Refund Policy, which explains how to request a refund and how we handle purchases that were not delivered.
You are responsible for purchases made on your device, including purchases made by children with access to it. Please use the purchase-approval and password settings offered by your App Store.
21. Sharing Rewards and Promotions
The Game may offer optional rewards for actions such as sharing the Game with friends. Any such reward is described in the Game at the time it is offered (currently, a one-time Coin gift for your first share), is granted only once unless stated otherwise, and may be changed, suspended or withdrawn for future participants at any time. Attempting to obtain such rewards repeatedly through manipulation, multiple installations or automated means is prohibited. We do not receive the content of your message or the identity of the people you share with.
22. Nicknames, Flags and Player Conduct
You choose your nickname, flag and avatar. You must not use a nickname that: contains personal information about you or another person; impersonates another person, a brand or a member of our team; is offensive, hateful, discriminatory, sexual, violent or otherwise inappropriate; promotes illegal activity; or infringes anyone's rights.
Your nickname, flag, avatar, best score and highest colour level are visible to other players on the global leaderboard. We may change, hide or remove any nickname or leaderboard entry that breaches these Terms or applicable law, and may restrict access to online features in case of repeated breaches. To report an inappropriate nickname, write to info@gemuzen.com.
Nicknames are checked automatically against a list of prohibited words when you choose them, and reported nicknames are reviewed by us. Because players do not give us contact details, we usually cannot inform you individually when we change or remove a nickname; you may ask us about any such decision, or contest it, by writing to info@gemuzen.com.
23. Global Leaderboards
The Game includes worldwide rankings that are provided purely for entertainment. They may display a player's nickname, avatar, flag, best score, highest colour level and ranking position.
Some entries shown in the rankings are computer-controlled (simulated) players created by the Game for a lively and balanced experience. They are labelled in the Game (for example as "AI" or "CPU") and do not represent real people. Real players and simulated players may be displayed in the same list.
Ranking positions may change at any time as scores are updated, as fraudulent entries are removed, or following technical corrections or seasonal resets. Rankings create no contractual entitlement, property right or claim to any prize.
24. Weekly League
The Weekly League is a recurring in-game event based on the score you achieve during the week. The opponents shown in the Weekly League are computer-controlled (simulated) players; the League is a solo challenge presented in a competitive format, not a tournament against other real users. Rewards are virtual, are described in the Game, and may be changed, postponed, reset or discontinued for valid reasons. Participation does not guarantee any reward and involves no entry fee, stake or prize of real-world value.
25. Fair Play
You agree to play honestly. Prohibited conduct includes: cheating; exploiting bugs; editing saved data or memory; using bots, macros or automation; manipulating time settings to obtain rewards; falsifying scores or rankings; abusing rewarded advertisements; artificially generating Coins or items; using modified clients or unauthorised software; and attempting to bypass security or purchase mechanisms. We may investigate suspected breaches using reasonable technical means.
26. Fraud Prevention and Automated Checks
To protect the Game and its players, the Game performs automated checks (for example on unusual Coin changes, repeated reward claims and data written to our servers). Where fraud, manipulation or a technical error is detected or reasonably suspected, we may block, reverse or remove the affected benefits, correct balances, remove leaderboard entries or restrict access to online features.
If you believe that such a measure has affected you in error, contact info@gemuzen.com. We will review your case within a reasonable time and restore benefits that were removed in error.
27. Security
You must not interfere with the security or proper functioning of the Game, for example by introducing malicious code, attempting unauthorised access to our systems or to other players' data, disrupting servers or network communications, or attempting to gain administrative privileges. We take reasonable security measures but cannot guarantee absolute security; internet-based software always carries some risk.
28. Anonymous Play, Cloud Save and Loss of Progress
The Game does not use registered accounts. Your progress is linked to an Anonymous Game ID created on your device. Cloud save is provided as a convenience so that your progress can be backed up and restored on the same installation or, if you are signed in to Google Play Games, restored automatically when you reinstall the Game or move to a new device, and so that leaderboards can work. It is not a guaranteed backup service.
Because there is no account with a username and password, we cannot identify, recover or transfer your progress if the Anonymous Game ID is lost and no Google Play Games link is available, for example if you uninstall the Game, clear its data, reset or lose your device, or delete your data. Please consider this before clearing app data or changing devices. If you have turned on your device's own backup to your Google account, Android may restore the Game's local data on a new device; this backup is managed by Google and your device settings, not by us. We are not obliged to restore lost progress, Coins or items, except where required by applicable law or where the loss was caused by our fault.
29. Deleting Your Data
You can delete your data at any time in Settings → Delete Account & Data, or as described at gemuzen.com/delete-account. Deletion removes your cloud save, your leaderboard entry, your Anonymous Game ID and the Game's data on your device.
Deletion is permanent. Progress, Coins, cards and other Virtual Items are lost and cannot be restored, including Coins that were purchased. Deleting your data does not entitle you to a refund, except where applicable law provides otherwise. Details of what is deleted and what may be retained are set out in our Privacy Policy.
30. Offline and Online Functionality
Most of the Game can be played offline. Online connectivity is needed for cloud save, leaderboards, rewarded advertisements and purchases. We do not guarantee uninterrupted availability of online features; interruptions may occur due to maintenance, updates, network outages, third-party service interruptions, security incidents or force majeure. We are not liable for temporary unavailability of online features, subject to Section 38 and to your mandatory rights.
31. Local Storage
Game data stored on your device may be lost due to uninstalling the Game, clearing app data, device replacement, factory reset, storage corruption, malware, unauthorised modifications or hardware failure. We are not obliged to restore locally stored data that has been lost for reasons outside our control.
32. Restriction of Online Features
We may temporarily or permanently restrict access to online features (such as leaderboards, cloud save or rewarded advertisements) where we reasonably believe that you have breached these Terms, engaged in fraud or manipulation, abused advertising systems, compromised security, or breached applicable law or App Store policies.
We will apply such measures proportionately. Where practicable, we will inform you and give you an opportunity to explain, unless immediate action is needed to protect the Game, other players or third parties. You may contest a measure by writing to info@gemuzen.com. Offline single-player gameplay generally remains available.
33. Changes to the Game
The Game is an evolving product. We may add, change, rebalance, suspend or remove features, content and Virtual Items, for valid reasons such as: technical maintenance and security; adapting the Game to new devices or operating systems; complying with law or App Store policies; correcting errors; or reasonable development and balancing of the Game.
Where a change materially and adversely affects your access to, or use of, digital content you have paid for, we will inform you a reasonable time in advance through the Game, our website or the update notes, and, where the law grants you such a right (for example under EU rules on the supply of digital content), you may terminate this Agreement and may be entitled to a refund for any content that you paid for and have not used.
34. Discontinuation of the Game
We may decide to discontinue the Game or its online services. If we do, we will, wherever reasonably possible, give at least 30 days' notice in the Game or on our website, stop selling Coins from the date of the notice, and allow you to use your remaining Coins during the notice period. After the service ends, Coins and Virtual Items will no longer be usable and, except where applicable law requires otherwise, no compensation is due for unused Coins or items. Where the law of your country requires reimbursement of unused paid virtual currency, we will comply with that requirement.
35. Feedback
If you send us ideas, suggestions, bug reports or other feedback, you agree that we may use them without restriction, without compensation and without any obligation of confidentiality, and that we may develop similar features independently. You confirm that your feedback does not infringe anyone else's rights. This does not affect your rights in any content you own.
36. Export Controls and Sanctions
You confirm that you are not located in, and are not a resident of, a country or territory subject to comprehensive trade sanctions or embargoes that would make your use of the Game unlawful, and that you are not on any list of restricted or prohibited persons. You agree to comply with applicable export control and sanctions laws when using the Game.
37. Disclaimer of Warranties
To the maximum extent permitted by applicable law, the Game is provided "as is" and "as available", without warranties of any kind, whether express, implied or statutory, including warranties of merchantability, satisfactory quality, fitness for a particular purpose, non-infringement, uninterrupted or error-free operation, compatibility with every device or operating system version, or the preservation of progress, Coins or Virtual Items.
Consumers: nothing in this Section affects your statutory rights. In particular, if you are a consumer in the European Union, the EEA or the United Kingdom, you keep your legal rights relating to the conformity of digital content and digital services, including the right to have defects remedied and, where applicable, to a price reduction or a refund. Some jurisdictions do not allow the exclusion of implied warranties, in which case the exclusions above apply only to the extent permitted.
38. Limitation of Liability
To the maximum extent permitted by applicable law, we, our owners, employees and contractors are not liable for indirect, incidental, consequential, special, punitive or exemplary damages, or for loss of profits, business, goodwill, opportunity, data, virtual items, Coins, achievements or gameplay time, arising from or relating to your use of, or inability to use, the Game.
To the maximum extent permitted by applicable law, our total aggregate liability arising out of or relating to the Game will not exceed the greater of (a) the total amount you actually paid for in-app purchases in the twelve (12) months before the event giving rise to the claim, or (b) ten United States dollars (USD 10).
These limits do not apply to: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; gross negligence or wilful misconduct; liability that cannot be excluded or limited under applicable law; or the statutory rights of consumers, including rights in respect of defective digital content. If you are a consumer, we are liable for foreseeable damage caused by our breach of these Terms in accordance with the mandatory law of your country of residence.
39. Third-Party Services
The Game relies on third-party services, including Google Play services, Google Firebase, Google AdMob, App Store billing systems and, where applicable, Apple services. We do not control their availability, security, pricing, policies or continued operation, and we are not responsible for their acts or omissions, except to the extent that applicable law makes us responsible for the acts of parties we engage to perform the contract with you. Your use of those services is also subject to their own terms and privacy policies.
40. Force Majeure
We are not liable for any delay or failure to perform caused by circumstances beyond our reasonable control, including natural disasters, fires, floods, epidemics, war, terrorism, cyberattacks, internet or power outages, government actions, sanctions, and failures of hosting, cloud or platform providers. Our obligations are suspended for the duration of such an event.
41. Termination
These Terms apply until terminated. You may terminate at any time by uninstalling the Game and ceasing to use it; deleting your data as described in Section 29 also ends the processing of your cloud data. We may terminate or suspend this Agreement where you materially breach these Terms, where required by law, or where we discontinue the Game in accordance with Section 34.
On termination, the licence granted to you ends, and Coins and Virtual Items may become permanently inaccessible. Sections that by their nature should survive termination (including intellectual property, disclaimers, limitation of liability, indemnification, governing law and dispute resolution) continue to apply.
42. Indemnification
To the maximum extent permitted by applicable law, and except where you act as a consumer and such an obligation is not permitted by the law of your country, you agree to indemnify and hold us harmless from claims, damages, losses and reasonable expenses arising from your breach of these Terms, your misuse of the Game, your infringement of third-party rights, your fraudulent conduct or your unauthorised modification of the Game.
43. Governing Law and Consumer Rights
These Terms are governed by the laws of the Republic of Azerbaijan, without regard to conflict-of-law rules.
If you are a consumer, this choice of law does not deprive you of the protection of mandatory provisions of the law of the country in which you habitually reside. Consumers in the European Union, the EEA and the United Kingdom keep all rights granted by the consumer protection law of their country, including rights concerning digital content, unfair contract terms and dispute resolution.
44. Complaints and Dispute Resolution
If you have a complaint, please contact us first at info@gemuzen.com. We aim to respond within 14 days and to resolve complaints in good faith.
If a dispute cannot be resolved, it may be submitted to the competent courts of the Republic of Azerbaijan; however, if you are a consumer, you may also bring proceedings in the courts of your country of residence, and we may bring proceedings only in those courts where mandatory law so requires. Consumers may also be entitled to use alternative dispute resolution or consumer mediation bodies available in their country. Nothing in these Terms limits your right to bring a claim in a small claims court where available.
45. General
- Severability: if a provision is found unlawful or unenforceable, it will be applied to the maximum extent permitted and the remaining provisions stay in force.
- No waiver: a delay in exercising a right is not a waiver of that right.
- Assignment: you may not transfer your rights under these Terms. We may transfer ours in connection with a merger, acquisition, reorganisation or sale of assets, provided that this does not reduce your rights.
- Entire agreement: these Terms, together with the documents referred to in Section 1, form the entire agreement between you and us regarding the Game.
- Contact point: our single point of contact for users and authorities, including under Articles 11 and 12 of the EU Digital Services Act, is info@gemuzen.com. You can write to us in English or Azerbaijani.
- No professional advice: our documents are not legal, financial or tax advice.
- Language: these Terms are written in English. If they are translated and there is a conflict, the English version prevails to the extent permitted by law.
46. Additional Terms for the Apple App Store
The following applies if you obtain the Game from the Apple App Store: this Agreement is concluded between you and GemuZen Studio only, and not with Apple. Apple is not responsible for the Game or its content. Apple has no obligation to provide maintenance or support for the Game. If the Game fails to conform to any applicable warranty, you may notify Apple, and Apple may refund the purchase price; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the Game. Apple is not responsible for addressing any claims relating to the Game, including product liability claims, claims that the Game fails to conform to legal requirements, and claims under consumer protection or similar legislation. Apple is not responsible for investigating, defending or resolving third-party claims that the Game infringes intellectual property rights. You confirm that you comply with Apple's usage rules and the applicable export and sanctions requirements. Apple and its subsidiaries are third-party beneficiaries of this Agreement and may enforce it against you.
