1. Introduction
GemuZen Studio, the trading name of Taleh Sadıqov, an individual developer based in the Republic of Azerbaijan ("Developer", "we", "us", "our"), respects intellectual property rights and expects players, visitors, partners and third parties to do the same. This Copyright Notice and Intellectual Property Policy explains who owns what, what you may and may not do with our content, how fan content is treated, and how to report alleged infringement, including through a notice-and-takedown procedure modelled on the U.S. Digital Millennium Copyright Act ("DMCA", 17 U.S.C. § 512).
This Policy applies to the GemuZen mobile game, our website, promotional materials, social media content, software, artwork and documentation, and forms part of our Terms of Use.
2. Ownership
Unless expressly stated otherwise, all content in GemuZen, to the extent it is protected by intellectual property law, is owned by or licensed to GemuZen Studio, including: software and source code; gameplay mechanics and systems; original artwork and illustrations; user interface and user experience design; interface layouts and trade dress; logos and branding; icons, avatars and themes; collectible card designs and the collection system; animations and visual effects; sound design and music; written text and translations; databases and data structures; documentation; promotional materials; and website content. All rights are reserved.
3. Third-Party Materials and Attributions
Some materials used in the Game and on the website belong to third parties and are used under their licences. They remain the property of their owners, and we claim no ownership over them. Current sources include:
- A small number of icons from Freepik (including icons by the contributor rawpixel.com on Freepik) and Vecteezy, modified by us, and sound effects from Pixabay, used under their respective licences. The collectible card artwork, the logo and the app icon are our own work;
- Country flag images based on public-domain flag artwork made available through Flagpedia (flagpedia.net);
- The Inter typeface, used under the SIL Open Font License 1.1, in the Game and on our website (served from our own server);
- Software components including Capacitor and its official plugins (MIT Licence), the Capawesome Firebase plugins (Apache Licence 2.0), the Firebase SDKs (Apache Licence 2.0 for their open-source parts), AndroidX Media3 and other AndroidX libraries (Apache Licence 2.0), the Google Play In-App Review library and the Google Mobile Ads (AdMob) SDK.
Open-source components remain subject to their own licences, which continue to grant you the rights they provide. If you believe an attribution is missing or incorrect, please contact us and we will correct it.
4. Your Licence to Use the Game
Subject to the Terms of Use, you receive a limited, revocable, non-exclusive, non-transferable licence to use GemuZen for personal, non-commercial entertainment. This licence does not allow you to: copy, extract or redistribute game assets; modify or create derivative works based on the Game; reverse engineer the software except where the law expressly permits it; create competing games using our assets; sell, sublicense or commercialise any part of the Game; upload our assets to asset stores or marketplaces; or remove copyright, trademark or attribution notices.
5. AI Training, Text and Data Mining, and NFTs
We expressly reserve all rights in our content against text and data mining, web scraping and the training, fine-tuning or evaluation of artificial intelligence or machine-learning models, including for the purposes of Article 4(3) of Directive (EU) 2019/790 and any equivalent rights reservation mechanism. Any such use requires our prior written permission.
Our content may not be used to mint, advertise or sell non-fungible tokens (NFTs) or similar blockchain assets, or to generate derivative artwork for commercial distribution.
6. Use of AI Tools in Development
Parts of GemuZen may have been created or refined with the assistance of artificial intelligence tools, for example artwork, icons, card illustrations, sound, translations, interface text or code. In particular, the Game's background music was generated with Google's generative AI music tools and then selected, edited and arranged by GemuZen Studio; it is not presented as a human composition. All creative selection, review, modification, arrangement and publication decisions are made by GemuZen Studio, and we hold or license the rights necessary to use the resulting content in the Game. Nothing in this Policy grants permission to reproduce or reuse AI-assisted content outside the Game.
7. Trademarks
"GemuZen", the GemuZen logo, our slogans, branding and distinctive interface designs are trademarks or unregistered trademarks of GemuZen Studio. You may not use them in a way that suggests sponsorship, endorsement or affiliation, as part of another product or service name, in domain names, or in a manner that is misleading or damaging. Nominative references (for example "a video about GemuZen") are permitted.
8. Press, Reviewers and Content Creators
Journalists, reviewers and content creators may use screenshots, short gameplay clips and official logos to report on, review or discuss the Game, provided the material is clearly attributed to GemuZen and is not altered in a misleading way. For press materials or permissions beyond this, contact info@gemuzen.com.
9. Fan Content Policy
We are happy for players to create and share content about the Game. Subject to this Policy, we grant you permission to:
- publish screenshots, recorded gameplay videos and live streams of the Game, including on platforms that share advertising revenue with creators;
- create non-commercial fan art, wallpapers and similar creative works inspired by the Game.
Conditions: credit GemuZen and, where practical, link to gemuzen.com; do not imply that your content is official or endorsed by us; do not use our content for hateful, harassing, sexual, illegal or misleading purposes; do not sell our assets, sell fan works that mainly reproduce our artwork, or use our content for AI training or NFTs; and do not distribute modified versions of the Game or tools that help players cheat. We may withdraw this permission for specific content or creators where these conditions are not met.
10. Player Content in the Game
The Game does not allow players to upload images, audio, video, files or custom artwork. The only content a player can create is a nickname (and the choice of a flag and avatar from the options we provide), which is displayed on the global leaderboard. You are responsible for your nickname and must not use one that infringes another person's rights, impersonates someone, or breaches our Terms of Use. We may change, hide or remove nicknames that breach these rules. If a nickname infringes your rights, please report it as described in Section 11.
11. Reporting Copyright Infringement (Notice and Takedown)
If you believe that material in the Game, on our website or in our promotional content infringes your copyright, send a written notice to info@gemuzen.com with the subject "Copyright notice", including:
- your full legal name and contact details (email, and postal address where available);
- identification of the copyrighted work you claim has been infringed;
- identification of the material you claim is infringing, with enough detail for us to find it (for example a screenshot, a screen name and the exact location in the Game or on the website);
- a statement that you have a good-faith belief that the use is not authorised by the copyright owner, its agent or the law;
- a statement, made under penalty of perjury where applicable, that the information in your notice is accurate and that you are the copyright owner or authorised to act on the owner's behalf;
- your physical or electronic signature.
We aim to acknowledge complete notices within 10 business days and to act expeditiously where a claim appears valid, which may include removing or disabling access to the material. Incomplete notices may not be processed. Knowingly submitting a false or fraudulent claim may create legal liability, including under 17 U.S.C. § 512(f).
Although the Game does not host user uploads, we follow this DMCA-style procedure voluntarily, and we also respond to valid notices under other applicable laws, including in the European Union and the United Kingdom.
12. Counter-Notification
If material of yours was removed or disabled and you believe this was the result of a mistake or misidentification, you may send a counter-notification to info@gemuzen.com including: your full name and contact details; identification of the material and its location before removal; a statement under penalty of perjury that you have a good-faith belief that the material was removed as a result of mistake or misidentification; your consent to the jurisdiction of a competent court, where required by applicable law; and your signature. We may forward your counter-notification, including your contact details, to the person who submitted the original complaint.
13. Repeat Infringement
We may restrict or terminate access to the Game's online features for users who repeatedly infringe intellectual property rights, and we may remove infringing material where permitted by law. Measures are applied proportionately and may be contested by contacting us.
14. Copyright Exceptions
Nothing in this Policy is intended to limit rights you may have under copyright exceptions such as fair use, fair dealing, quotation, parody, criticism, review, news reporting, educational use or similar doctrines recognised by applicable law.
15. Open-Source Notices
The Game includes open-source software. The applicable licence texts and copyright notices are listed in our Open Source and Third-Party Notices, and a complete copy can be requested at any time by writing to info@gemuzen.com.
16. Reservation of Rights
All rights not expressly granted in this Policy or in our Terms of Use are reserved by GemuZen Studio and its licensors. No licence is granted by implication, estoppel or otherwise.
17. Changes to This Notice
We may update this Policy, for example following legal developments, platform requirements or changes to the Game. The current version is published on this page with its "Last updated" date and applies from publication.
